What Is A Disability?
The Social Security Administration provides benefits to people who cannot “engage in any substantial gainful activity by reason of any medically determinable physical or mental impairment.” Additionally, this condition must be long term, meaning it is expected to last – or has lasted – at least 12 months. Qualifying conditions include:
- Paralysis
- Post-traumatic stress disorder
- Amputations
- Blindness
- Multiple sclerosis
It also includes any number of permanent, incurable or long-lasting conditions that prevent a person from performing work.
However, there is often a case in which a disability may prevent one from performing their current work duties but does not prevent them from any and all work. In these situations, it is possible to receive “partial disability benefits.”
What Benefits Are Available?
Disability benefits allow for people to receive salary replacement, assistance with hospital bills and reimbursement for needed accommodations in a new position. Social Security regulates these, benefits and it may require additional assistance from an attorney to protect your benefits.
